概要

This course provides an essential knowledge of international public law focusing on the Conflict and Security Law. The method of work is an intensive reading of the designated research handbook followed by discussions in order to enhance students’ research capacity.

This course is officilally recognised as Hiroshima-Nagasaki Peace Study Course.

科目の到達目標

This course aims to enhance the students' research capability especailly to draft an academic research note. Therefore the submission of a research note at the end of this academic year,which should be between 3,000 and 5,000 words including footnotes etc., is mandatory.

受講要件

A good command of English to understand the issues related to Conflict and Security law is prerequisite. This course is composed of 2 parts and the students are thus obliged to attend both of them.

事前・事後学修の内容

It is recommended to read a standard textbook for international public law in advance. It is also expected to understand the importance of the peace study in the context of Hiroshima city that experienced the first atomic bombing in human history through this course.

講義内容

  • After the stocktaking of the progress in the 1st semester for Conflict and Security Law, this course covers, inter alia,the following issues (chapters11-19):
    -Protected persons in international armed conflicts,
    -Private military companies,
    -International humanitarian law and human rights law,
    -War crimes,
    -Peace settlements and international law: from lex pacificatoria to jus post bellum,
    -Foreign territorial administration and international trusteeship over people: colonialism, occupation, the mandates and trusteeship arrangements, and international territorial administration,
    -Peacekeeping or war-fighting?
    -Human rights protection during extra-territorial military operations: perspectives at international and English law
    -Reparation and compensation.
  • Discussions to facilitate drafting a research note.
  • On-site visit to the war memorial site such as A-bomb dome and listening to the Hibakusha testimony.
  • Presentation of the research note (in the final class of the 2nd semester)

評価方法

Assessment is based on the quality of the submitted research note and its oral presentation.

担当者プロフィール

LL.D. (Docteur en droit) from Université Paris 1 (Panthéon-Sorbonne). His specialization is international disarmament law and so on. After 28 years of diplomatic service, he left the Ministry of Foreign Affairs of Japan in March 2015, and assumed his current post at the Hiroshima Peace Institute, Hiroshima City University.
